Yes, the hurdle the FL supreme court is much higher than the media has portrayed.

Here is the language that has got them in trouble
"Because the right to vote is the pre-eminent right in the Declaration of Rights of the Florida Constitution, the circumstances under which the Secretary may exercise her authority to ignore a county’s returns filed after the initial statutory date are limited. (emphasis added)

Which is contrary to constitutional authority given her by the legislature. They cannot simply rewrite the opinion, they must demonstrate that what they have done does not violate US code and the US constituion.

The court simply said, fix your mess or we will fix it for you.

And make no mistake, they did not need to vacate the order to remand it back to Florida. This is not a status quo situation.

At the very precarious risk of making predicitions, I think what is going to happen is that the FL supreme court will deny the Gore appeal of the Saul decision. The resonse to the US Supreme court will be that this matter is moot, and therefore no resoponse is necessary. The supreme court set aside will then become the final word.
