This does not answer the question about the possibility of crafting a remedy that is fair to both Democrats and Republicans. If the Republican absentee ballots were counted but the Democratic absentee ballots were discarded, why can't the judge simply order the Democratic absentee ballots to be counted?

Re Seminole absentee ballot case. The parties just argued Bush's Motion to Dismiss, for Judgment on the Pleadings, or alternatively, for Summary Judgment this evening, and the judge refused to grant it (at least on the first two. She apparently will review a Stipulation of Facts to see if Summary Judgment is appropriate). Trial is scheduled to start at 8:30 tomorrow morning.
