Not necessarily. That is the remedy (or what they want to make them whole) they seek. The judge can:

1. Find for the Defendant
2. Find for the Plaintiff and grant the remedy they ask
3. Find for the Plaintiff and grant a remedy of her own making (within the law's of the state of Florida) or no remedy
