I don't know whether the judiciary was intended to be the weakest branch, but they were intended to be the final say over matters, without fear of having unpopular rulings in cases between parties overturned by the legislature. This has been true since the early 1800's when the Supreme Court ruled that Congress could not determine, as final arbiter the constitutionality of its own laws.

We don't like the result of Smith vs. Jones? Let's have the legislature overturn it. In two years, when there's a different legislature, let's reinstate it. This is a dangerous game when people do not and cannot believe that their day in court represents a final determination of their controversy.
