Lost in our focus on Florida is the Bush camp's equal protection case being argued up in Atlanta. A lot of conservatives are very nervous that this case was brought, because they think that it's an invitation for Democrats to do the same thing down the road. There is a point to be made for that, but the equal protection clause has been invoked here on the manual recounts for a sound reason.

In this case now before the 11th Circuit Court of Appeals, the Bush campaign is saying, "Wait a minute! Wait a minute! Wait a minute! You can't only count the ballots in three selected Democratic Florida counties and then base an entire state's election on that, because by doing so you grant far more weight to ballots in those three counties than to ballots in the rest of the state."

So the Bush campaign is arguing that these manual recounts ought not be occurring at all on the basis of the equal protection clause. And they might win that. If they do, then what happens before the Florida Supreme Court on Thursday is all moot, because you will have a federal appeals court ruling that the manual hand recounts cannot take place on the basis of the equal protection clause of the Constitution.

If the 11th Circuit rules for Bush, Algore would have to ask the U.S. Supreme Court to overturn the ruling. But remember, Florida's electors are already certified with the National Archives. So even if all these court cases go "against" Bush, the Florida legislature will simply step in, assert itself, name its own slate of electors, and that will be that.
