So wait-let us say that in New Jersey, I have a small business client who sues XYZ Corp., a large and influential New Jersey corporation. We win at the trial level, we win at the intermediate appellate level ,and then New Jersey's highest Court affirms.

The decision proves unpopular with the New Jersey legislature, and they vote to overturn it as expressing "judicial activism." The matter, a private business dispute, is of great import to XYZ Corp., but of little concern to the general public.

The legislature has overturned all my court victories. You believe my small client can now vote out the legislature?

I don't think you've thought through all of the implications of this.
