Hi Gordon. Thank you for that terrific source. The point is, there is a lot of hub bub about unelected Judges "making laws". But, what about unelected juries making an end run at the same goal by refusing to apply the law? Personally, I agree with Jefferson and, I think, you, that nullification is a good thing. I also hold the opinion that a court may eb called upon to clean up the mess left by a sloppy legilsative body in writting laws. If the Legislature wants to be the final word on the law, they should be clear and concise. That will remove the need for a Judge to figure out their intent.
