I am pretty sure that under SEC rules individual investors can sue brokerages only in an arbitration setting. One cannot take them to civil court. Most lawyers will not take a case on if it involves arbitration. These brokerages (and their employees) are in a sense "protected" by the SEC. Change the rules and the lawyers will take the brokerage industry on like they did with the tobacco manufacturers.
