That is why it is imperative that the Florida Legislature step in and say. "The legal uncertainty over this issue requires us to step in and appoint electors."

There is no way that all appeals can be satisfied by the 12th of December.

Carolyn, I sort of humbly disagree with your buddy. He seems to be going over a smorgassboard of possible procedures. This is not a death penalty case. I believe the Justices on the FSC are very competent. The problem is that they were not given much Jurisprudential (technical legal reasoning) help from Richard.

I am going to wing it here because I really don't know what I am talking about in terms of Fla civil law. Even though the 9-13k votes were sequestered by the Judge, and I am not so sure they were ever admitted into evidence in Sauls court, but Richard CONCEDED that point, so it doesn't matter, they were not PROFFERED.

Boies, my good buddy, did not take a couple show them to Boyton (?) who was on the stand and say, IS THIS A VOTE THAT YOU WOULD HAVE COUNTED THAT YOU DID NOT? Answer, yes. THAT is the evidence. Boies did not do that with even one of the disputed ballots. He must show there are Votes that were not counted, not a statistical theorectical probability that there might be. Dimples are not Ballots under texas law, as I read it, without clear intent. Where was the evidence of CLEAR INTENT. What's left is guesswork, which the court will not engage.

He left it to the Court to determine that dimples show intent. This Sauls, nor any judge, will not do, not on the evidence presented.

AP National Clinton: Vote Need Not Split Country

WASHINGTON (AP) -- Regardless of whether Al Gore or George Bush emerges victorious in the drawn-out presidential election, some partisans will feel wronged, President Clinton said Wednesday.

And while trying not to appear too partisan himself, Clinton nonetheless made it clear he thinks Gore is correct to continue pressing for hand recounts in Florida.

''If the vice president is elected, there will always be some Republicans who don't believe he should have been,'' Clinton said in an interview with The Discovery Channel.

''If Governor Bush is elected, there will always be some Democrats who believe that Al Gore not only won the popular vote in the country, but also had more people in Florida who wanted to vote for him and perhaps more who did, which is, you know, one good argument for counting all the so-called undercounted ballots ... .''

Clinton said close elections do not have to split the country

''Back in 1800, we had 36 ballots in the House of Representatives before we resolved it, and it produced Thomas Jefferson, and Thomas Jefferson turned out to be successful because he was mindful of how divided the country was,'' Clinton said.

''So I think that you cannot predict how this is going to come out. I think it depends a lot on whether the constitutional system is followed, the will of the people is determined. And then it depends on how people behave once they get in office.''
