Not frivolous at all. There is precedent that all absentee votes be thrown out, yes, actual cases in FL, even when fraud or impropriety does NOT exist.

I watched the whole defense case on TV and it is pretty clear that could happen, because it has been the remedy in the past in other cases, except in two cases cited nationally where the court ruled to throw out a percentage.

The latter is a silly way to do it because it is so arbitrary since co-mingling has occurred. The former would be unfortunate but it is the law that was even made stronger by the Republican-majority legislature in FL in 1998.

I am not in favor of throwing out all the absentee votes, I am just saying it COULD happen. Don't kid yourself which many of you Bush supporters tend to do. The courts rely HEAVILY on precedents; indeed they virtually have to.

There is no point us speculation anything, 2 cases and 2 judges are all that counts.
