Got me...Title 3 basically says that the Congress must ratify the votes selected by each state in accordance with state law, so I don't think there is a Federal issue there.

So, if it is state law that governs(and I think it does)then does not that law say 1. the people vote; 2. the SoS certifies the vote;3. the Governor signs off on the certified vote and 4. the votes are transmitted to the Archivist.

All of that has already been done. IF there are challenges to that slate, I just don't see what introducing an ADDITIONAL slate from the legislature would add other than redundancy.

Who would resolve the conflict between the current slate and a court mandated new slate(if recounts were done and showed Gore to go over the top). By my understanding, the Congress makes the final decision in accordance with the terms of 3 USC 1-15 and they would select the Bush slate already submitted.

I'm not a Constitutional expert but that is how the Section reads does it not??
