And it is encombent upon the plaintiff to seek a fair remedy.

For example, If you have an old chevy, a junker parked on the street, and some drunk comes along and plows into it, you dont get a BMW to replace it. Even if you want to punish the drunk, it would not be fair to the 3rd party in this case, the insurance company.

The same is true here, The remedy sought cannot punish the third party, the voter. It would be within the power of the judge to order a statewide recount of undervotes, but he is not under any obligation, legally to do so.
