Yes, Sam. And isn't that Delta case truly bizarre and unfair? Or how about the McDonalds hot coffee case? The only reasonable measure of damages is the loss to the plaintiff, not what the defendant can afford to pay. If you must take that the defendant's ability to pay into account in computing punitive damages, I support a rule that says all punitive damages should become the property of the state. Why should the plaintiff reap a windfall?
