Political venting...

I know this is not the political thread but I just wondered if anybody here can explain to me how those 4 Justices in Florida could go against the things that Justice Wells said...

CHIEF JUSTICE WELLS' DISSENT

* Chief Justice Wells: "I could not more strongly disagree with their decision to reverse the trial court and prolong this judicial
process. I also believe that the majority's decision cannot withstand the scrutiny which will certainly immediately follow under the United
States Constitution. My succinct conclusion is that the majority's decision to return this case to the circuit court for a count of the
undervotes from either Miami-Dade County or all counties has no foundation in the law of Florida as it existed on November 7, 2000, or at
any time until the issuance of this opinion." (p. 41 Dissenting Opinion of Chief Justice Wells)

* Wells: "Under our law, of course, a decision of a trial court reaching a correct result will be affirmed if it is supportable under any
theory, even if an appellate court disagrees with the trial court's reasoning. Dade County School Bd. V. Radio Station WQBA, 731 So. 2d
638, 644-645

* Wells: "Directing the trial court to conduct a manual recount of the ballots violates article II, section 1, clause 2 of the United
States Constitution, in that neither this Court nor the circuit court has the authority to create the standards by which it will count the
undervoted ballots. (p. 54)

* Wells: "A continuing problem with these manual recounts is their reliability. It only stands to reason that many times a reading of a
ballot by a human will be subjective, and the intent gleaned from that ballot is only in the mind of the beholder. This subjective counting
is only compounded where no standards exist, or, as in this statewide contest, where there are no statewide standards for determining voter
intent by the various canvassing boards, individual judges, or multiple unknown counters who will eventually count these ballot. I must
regrettably conclude that the majority ignores the magnitude of its decision.

* Wells: "To me, it is inescapable that there is no practical way for the contest to continue for the good of this country and state." (p.
58)

Hi Mark,

The nitely Gizzard report sound great. Hope it won't get you in dutch with the frau for spending too much time on the computer. I'll be glad to contribute a stock or two from time to time, and will add what ever else you think I can as well.

XAU is completing a nice right side of cup but I anticipate the handle at the resistance of 52.75. If things stay in turmoil, the handle may be short and we'll be off to the races. My golds remain ABX NEM HM and PDG. AEM seems to suffer from low volume and so is suspect to me.

Another H&S top to look at is TGH.

Pattern is 67 by 81 1/2 giving target of 52 1/2. It's interesting that the 200ma is at 51 1/2 and rising...so it agrees with the target area. 52 was also the last area of it's consolidation breakout...which interestingly looks like a failed H&S top.

Hi Mark,

I have no ideal on which way the market will go Monday, especially since the Federal Supreme Court suspended the recount. I'm still long a JNPR call(gulp...was still driving back when the closing bell rang). I think the big boys have started playing ball, so I'm not sure how much potential the darkside will have. So if I do play the darkside, it will be very short term, & I'd probably play JNPR, JDSU/SDLI, as they are part of the NDX 100 or S&P 500 so the sell programs would accelerate any panic selling, although the reverse can always happen with these strong companies and squeeze the shorts into rocket ships. Another potential player might be BRCD.

If Monday is up, I'd probably play any of the above on the long side also. BWDIK?
