The partial recount issue is before the 11th district court of appeals. So you're right I think Bush can tack laterally and go up to the US SC by the route established with his original suit, which was shut down temporarily only on grounds that since Bush was ahead anyway, there was no reason for the court to proceed (talk about a punt!).

Totally unconstitutional !!! - read this Not only is it Partial recounts - but the Kangaroos counted : 215 Palm Beach votes (which is the incorrect number) 168 votes in Miami-Dade - which is a partial recount of ONLY Democratic precincts - No Republican / Hispanic / Cuban precincts were recounted and won't be under this ruling TOTALLY UNCONSTITUTIONAL Interesting that the 3 who dissented were the oldest, and most senior judges
