According to MSNBC there was a high probability. The interesting thing is that the Bush team apparently was ready for this contingency (more so than anyone might have believed). They were fairly certain that they could not find four FL SC justices to go along with their position, given the history.

I do not think that a US SC hearing is required to issue the stay. It would be achieved by conference call.
