I wasn't aware that the Florida SC could make that pre-determination on appellate review.

Gore was shot down in this ruling. The court granted relief no one sought. Gore's lawyer argued against counting all the counties involved, and he lost bigtime in that regard.

Isn't it a bit late for all of this? The FL SC set a time to have the vote certified, which, they LEGISLATED after the election was over. The Fl. Legislature had set a time before the election. So we have the likelihood of the US SC overruling todays decision.
