ON FRIDAY NIGHT Bush campaign lawyers sought an emergency stay from Justice Anthony Kennedy, the member of the U.S. Supreme Court who is responsible for the 11th Circuit, which includes Florida.
If Kennedy issued a stay, it would stop the recount, pending Bush’s appeal of the Florida Supreme Court’s decision to the full U.S. Supreme Court.
Bush’s legal team will likely contend that the Florida court did not heed the warnings contained in the justices’ ruling on Monday.
In the Dec. 4 ruling, there were strong hints that a majority of the justices believe that the Florida Supreme Court encroached on the authority of the state Legislature by extending the vote count deadline.
