Those are interesting points I hadn't thought about. The question is whether they rise to a federal constitutional level. I guess they likely do if you want them to, which brings us back to the political makeup of the US Supreme Court.

I do think that a recount of just the undervotes could be completed by the 12th if the counties work diligently - however I'm sure some counties will drag their feet.

We might end up with Strom Thurmond yet! That would certainly put Bush's alleged mental deficiencies in perspective. <g> (Strom recently suggested that he might retire early and let his wife take his place, forgetting he's been estranged for 22 years.)

The competing analysis I heard last night though (from an ex-clerk of SOuter's) suggested that if there are two competing slates from Florida, and Congress then splits, it's left to the Florida Governor to decide.
