Let us hope the 5 can muster their cohorts. More of them anyway. We know Ginsberg will always be a dissenter.

What gave the USSC the courgage to come out 5-4 when they didn't before was the FSC's 4-3 decision. If the FSC had been unanimous, I don't think the USSC would have acted on an announced vote, and maybe not at all. But I think they realized that if the FSC was this close, there would be no greater public outcry if they came out with a 1 vote margin decision.

I hope the voters of Florida remember these judges when it comes time to vote them up or down.

I made a prediction some time back that this election would be decided when the U.S. Supreme Court came out with a 5-4 decision. I haven't gotten many predictions right during this election, but I may have gotten the final one right.
