It is sort of like the situation which occurred in the original IS-95 development. Just about every major telecom manufacturer had agreed to pay royalties....except Ericsson.

Back then the members and potential members of the value chain were suing QCOM and challenging the awarding of QCOM's patents. The Ericcson capitulation itself resulted in the withdrawal of its suit against QCOM. If we remind ourselves that the value chain supports the Gorilla out of dire need driven by no other reasonable alternative, the current status is significantly improved over the last 18 months; the value chain isn't 100% behind Qualcomm yet but it doesn't seem to be so agressively trying to wrestle itself from the control Qualcomm has over the architecture.
