The only way to read Scalia's concurring opinion and Stevens' dissent -- rare events, indeed, on a motion for a preliminary injunction when the court knows the final decision will be rendered within 48 hours -- is that the court majority is rock solid determined to deliver Bush to the White House. This is a purely political decision made by a radical right-wing faction that has been politicizing the Supreme Court for two decades. Their decision won't change unless one of them strokes out or Glenda The Good Witch gives Thomas a brain.
