Yes, I was very surprised....!

Bush's party fears the hand count and believes they can over come any 'legitimacy concerns' by mandating authority and/or secularizing it to democratic partisanship.

I would feel the same way if the party roles were reversed.

If the republicans lose.., the powerful Texas Senators are not going to roll-over in the coming 4 years and congress would be come a bitter battle ground. These two individuals, Armey and Lott have never demonstrated a predilection to subjugate their demands and political interests at any time previously in their power base existence for the considerations of compromise.
They prefer to "Just Lose and make it Tough."

In some ways it would be better for Bush to win, because the democrats are better at seeking compromise and reconciliation. Conservative Republicans are very narrow in their ability to bend, and they will control GW Bush.

On Saturday afternoon, the Supreme Court entered the legislative process in an emotional and partisan manner. They have now added the Court to the List of "Divided Governmental Bodies."
They can't Avoid this caricature now.
