Actually, I admire the judge who crossed over to the majority side, at least we know that s/he was not willing to allow the Dade count alone decide the outcome --- and it seems this solitary judge at least was willing to ignore the law to do what he truly believes to be the right thing (recount in all counties), while not ignoring fundamental rules of fair play (not doing the count in 1 county).

I do realize that without rule of law, chaos is often the inevitable result, but deep inside, I always hold people who will not let rules or regulations stand in the way of true conviction or principles (as long as those conviction and principles can withstand the glare of sunlight).

It is quite strange, but it seems that if Katherine Harris (the big evil partisan GOP (vbg)) had been allowed to certify on Nov14th(?) and the contest wound up all the way at the FSC, it would be sometime around Nov20th, which would not have alerted the the USSC until then.

At that point, if the FSC ordered the recount all-state at Nov21st, there would be plenty of time to complete it before Dec12th. But without the earlier warning from the FSC, would the FSC order the recount in the 3 counties only? The unfairness would be so blatant that the USSC might still step in. Too many ifs here.

Trying to guess people's true motivations is very hard, and I could be totally out to lunch, but the facts alone seem pretty damning on 3 of the sitting judges on the FSC.
