I am blaming the idiocy on the legislature. However, idiotic laws can be considered unconstitutional and not trumping proper laws. E.g. Equal protection amendment can be considered supreme here and a pre-existing law. This could be the Supreme Court argument and worth listening to.

Now, just because by accident some people are born deaf, we could blame their parents or whatever, but we don't AND we don't treat them unfairly AND we scorn those who treat the deaf unfairly because of their deafness. Similarly, just because idiotic, unfair laws exist, one shouldn't try to take advantage of them and try to advance one's cause.
