Nadine... she didn't use her "discretion" AT ALL.

She simply followed the law that stated that certification shall occur within 7 days of the election.

SHE UPHELD THE LAW, that's all.

So what you're apparently mad about is that she didn't make a special exception for Al Gore like Palm Beach did in permitting manual recounts.

And the FLSC IS the point. They clearly EXCEEDED THEIR JURISDICTION AND DISCRETION by usurping the state legislature's constitutional right to decide and implement election laws.

At one point, Miami/Dade announced their intention to do likewise but then changed their minds.

They ONLY DID SO when republicans pointed out that their own canvassing laws PROHIBITED THEM FROM SELECTIVELY MANUALLY RECOUNTING A PORTION OF THE BALLOTS. If Dade was going to manually recount, they had to recount ALL OF THEM, including the republican dominated precincts.

Fair play would have been Palm Beach to 1.) NOT HAVE used an antiquated ballot system.. 2). Upheld the same standard for this recount as they have for previous elections, namely NO PERMITTING manual recounts. and 3.) having standards IN PLACE for determining how to manually recount votamatic ballots.

It is pretty obvious that changes need to be made, but in the interest of "fair play", as you put it, these changes should NOT be retroactively instituted once the election is over.
