CB--Yes, of course, the ultimate decision would have been (I'm writing in the past tense because it obviously ain't gonna happen now...) with the legislature, but I have no doubt it would have happened if both candidates would have asked the legislature to do it.

It's too bad it didn't happen, as the residual bitterness that will last from this election will be both strong and long lasting...

Bush and Gore could AGREE to ask the Florida Legislature to change Florida's laws after the election? As you say, that would be up to the Florida Legislature. The change would trigger Congressional scrutiny, as well, because it would put the manner of selecting the president outside the "safe harbor" of 3 USC 5. At any rate, it's in the realm of speculation. These gentlemen haven't agreed on anything yet.
