It is clear, however, that a stay should not be granted unless an applicant makes a substantial showing of a likelihood of irreparable harm. In this case, applicants have failed to carry that heavy burden. Counting every legally cast vote cannot constitute irreparable harm. Well, if they counted all the votes, Gore would win soooo wouldn't that constitute "irreparable harm" to Bush??? Hmmmmmm. Do you think maybe the applicants didn't make that point in their briefs?? K
