SCOTUS will want to do everything it can to produce greater than a 5-4 victory for the bush forces. I am sure more than 5 members want to rebuke the Florida SC. That can be done by allowing the recount and extending the 12/12 date by 36 hours that the stay cost the counters. BUT, combined with this would come standards:
1. no dimpled chads--penetration must have occurred
2. recount extended to Broward and the original hand recounted Miami votes and perhaps even Palm to make sure standards are followed uniformly throughout the state.
3. A starting point total which adds back Broward and Miami votes to Bush and includes absentee recount where done if absentees are not now being reviewed as well.
4. This result would supercede anything Florida legislature does.

My belief is that Bush would easily win this recount and in any case victor would be accepted by the American people. I believe this option or a variation of this option has a 1 in 5 shot and probably would have a 9-0 SC vote behind it. Markets will tank briefly but recover as results become clearer. The true test would be if we could get some SI folks from both sides behind it.
I still believe that Gore did the nation a disservice by placing personal gain above national interest but I can live with the outcome and would believe Gore the winner if he could overcome the formidable lead Bush would have.

Well, the Supreme Court elected this one! I won't watch The State of The Union address, but if the Supreme Court turns up, and I'm sure they will, I wonder if they will clap when the President speaks!!!

There are not suppose to clap because they are not suppose to have a partisan position.
