The 5 member majority of the Court has now taken an active role in the Bush transition team. Generally, the Court tries very hard to maintain the appearance of political impartiality. It will break on liberal vs conservative issues but not on political sides. One exception was the Supreme Court decision on the Japanese internment cases where the unanimous Court joined the side of popular political opinion rathere than opposing the blatantly unconstitution internment actions.

I agree with all your points. For all the reasons you cite, I think that is why the Supreme CT has been so respected and trusted through the years. Its why people slept on the ground last night outside the court in order to be first in to view the proceedings. Its why the attorneys for both sides talk to the justices with great care and respect.

I hope that all of that is not lost in these proceedings.....too many people are watching.
