Overstated. The electors don't meet until Dec. 18. In the past electors have been sent up as late as Dec. 27 or 28. JLA

You're right, Nadine. It was NOT a neutral action. It was an outright Scalia-led charge on behalf of Bush. There's a sound opinion being floated about that perhaps Scalia should recuse himself, given that his son is a member of the same lawfirm as Ted Olson, who is arguing before the court on behalf of Bush.

The USSC could grant an extension if required, but if you read Scalia's opinion, you'll see that:

"It suffices to say that the issuance of the
stay suggests that a majority of the Court, while not de-ciding
the issues presented, believe that the petitioner has
a substantial probability of success."
