USSupCt swing votes are Kennedy and OConnor
Gore has 4 solid votes
Bush has 3 solid votes
they asked questions about federal jurisdiction
suspicions are further clarification may be requested from SexyHarris and the Legislature on ballot vote standard

legitimacy of presidency is the key here, not finality

I dont think this is over
if they rule for Bush, this is over
if they rule for Gore, we return to ballot examination
USSC does not want a cloud of illegitimacy hanging over

Scalia doesnt believe further vote counting even with clearer standards would add any more legitimacy
one thing is for sure: Scalia is the top dog on the court
