I don't agree. The only justices that were really all that concerned about it, were the minority. The majority was focused on the legality of any recount at this stage.

If (and a big-if at that) a recount is to happen, it must be complete, and under a uniform standard. All votes not counted under said standard must be recounted (yet again). This would indeed sway in the favor of Bush I believe. What comes into question (at least for me) is what of the 12/12 deadline....is it actually 12/18?
