That isn't the question. The question is: Are manual essentially unconstitutional when carried out without uniform standards? The answer is yes. Will they uphold it? Who knows?

Nadine..I think a recount of Broward with the total recount will make this a very close election indeed...you know you are only guessing about a Gore victory with any recount..we really don't know

They won't ever argue that a hand recount is unconstitutional. If they do rule on a hand recount, it will only be that a hand recount without prior established standards are not acceptable. I can understand, personally, hanging chads, but not dimpled cards. Heck, I could do that personally, with my thumb nail or a concealed punch. Without surveilance cameras, it would be virtually undetectable. TTT
