Hi Carl - I don't watch Sam Donaldson much, but I suppose his comment by itself has certain appeal to the non legal experts amongst us. After all, most of the working stiff in this country can appreciate "if you work hard, you will make it" kind of fair play. Personally, I also think Prof John Rawls's "A Theory of Justice" is romantically enticing <VBG>! Will the Law as written down allow fairness comes into play, I do not have the foggiest!

With regard to the USSC perceptual problem. Unfortunately, the dice was cast on Saturday when the majority decided to grant the Bush camp the stay order [incidentally, I am still very much puzzled by Justice Anthony Kennedy's action; however, I am sure he had good reason(s) when he reverted the 11th Circuit ruling by siding with the majority.] Even if it chooses to dismiss the case, the best it can do is to pass the ball back to FL Legislature since Dec 12th is the end of the safe habour. One benefit of dismissing the case, as far as the USSC is concerned, is to preserve its state right bias it has been cultivating for so many years.
