John, Re: I think the Bush supporters want only the voting machines to determine voter intent. They seem to be against any human interpretation of the undervotes.

Because that is the only sure way the result won't make Gore win, not that Bush would lose definitely but why the risk :-)

John,

It seems to me that setting specifications for interpretation of voter intent from the ballots, at this point in time, is truly changing the law after the election. Shouldn't the law, that the local election canvas determines the intent of the voter by their own logic, be the law that prevails before and after the election?

There is one standard that O'Connor touched on, and that was the voter instructions. I think it is a neutral standard, and it was agreed on prior to the elections.

Based on this standard, Broward and Palm Beach counties would have to be recounted, losing Gore 500 to 700 votes from those counties.

Joe

John, when the rules went from hanging chads to dimpled or pregnant chads, do you blame them? next they will just say well the voter was a Dem so we are counting them as a gore supporter. You can't trust people, you can't handle ballots for 5 weeks and then hold them up to light to see if any gets through the ballot and the edge of a chad, come on, it is ridiculous.
