That makes thing interesting as part of the arguments made by the Bush lawyers rested on the premise that the original decision of the FSC was invalid. The part of the Rep arguments based on ther original decision are now invalidated unless the USCC reverses or vacates the clarification from the FSC?
Yep I know they have other arguments.

Anyone care to speculate on how pissed off the Supremes will be that the FL Extremes spoke AFTER briefs were submitted and AFTER today's oral argument? I suspect the newly-cast, outcome-determinative decision will receive little, if any weight, and rightfully so. I, too, would like to be able to bet on the horses after the race.
