The move to manual recounts by the counties was discretionary. One of the counties completed its manual recount, and its results were accepted by Harris. The other counties did not hire sufficient workers, or work everyday. Harris did not grant them extensions because they had no adequate reason to fail to comply with the deadline, especially since they did not have to engage in the manual recount. Thus, Harris was refusing to bend the rules to accommodate them. As for the "clear intent" standard, obviously there could be legitimate disagreement on what constituted "clear intent", and obviously the wording is poor, and an invitation to litigation.

I have not denied that Bush doesn't want invalid ballots to be alchemically converted into votes. Whether there was some formula that would have been found acceptable, I cannot say. I think that he has behaved correctly in fighting against the Democratic attempt to manufacture votes.......
