When they asked Boise what the standard should be it really stone-walled him. He had to be careful. Basically he said that "voter intent" was the standard. Sounded like the USSC read that as way too loose a standard, basically no standard.
They could end it here or pass the buck back to the state to find a standard and recount. If they do the latter it will likely end up back in the USSC on the fairness of the standard. Now that I've had time to think about it, I doubt they will offer a standard.
