It's already started; all one really needs to do is consider who has the most to loose or gain from this outcome;
Take this judge who wants Thomas to recuse himself because his wife is attempting to live her own life.

This circuit court judge, was in line in his mind for an open seat on the Big court, I'd suggest he has a lot to lose.

Jesse Jacksons Strident calls extended over a two week time frame are self evident. Jesse has a lot to lose, while in the here and now, he does not mind at all sacrificing a few more black men in the cause.

Jesse has a big problem in that his voting block was fully enfranchised by this past election, he's maxed out, his percentages of voter delivery are statisticly in a situation of; it cant get any better than this.

His coalition shot their ammo in total. AT 90 odd % participation, he has maxed out his contributory content.

What we see now is the jockeying for future largess, yes these threats are his way of negotiating a seat back at the table, knowing full well the Bush team will have to come to him in their appeal for calm. Personaly, I hope they dont, but instead elevate a new face, to act as the calming influence, for the inflamed spirits of disconnected blacks.

Mr. Jackson is another with the most to lose. For him this is about survival.

I have taken a few minutes to decide how to comment on this, and dvdw has helped. The supposed conflicts mentioned are trivial. Obviously, Scalia and Thomas have an interest in Bush getting in. Scalia has a good shot at being the next Chief Justice, should Rehnquist retire, if there is a Republican President. Both stand to gain in influence if the court becomes more decidedly conservative. Thomas owes a debt to Bush's father for nominating him and standing by him during the Hill controversy. Conversely, the more liberal judges have their best shot at putting one of their own in the Chief Justice spot, or increasing their influence, should Gore be elected. I am sure one could discover more potential conflicts if one looked. In general, there is a conflict of interest affecting everyone, and no one need recuse him or her self.......
