Just because a statute has not been challenged, after standing unchallenged for many years, does not make it invulnerable to a constitutional challenge.

A couple justices yesterday themselves said how can you have standards when the quality of the voting machines varies so widely throughout Florida.

Yes, but you failed to listen to the response given to the justices. It was essentially this: yes there are different standards for different counties that use different machines(IOW, he agrees with the justices here as he should have), but he goes on to say that even within counties and among counties that use similar machines and punch ballots, that standards were not only changed several times and were evolving to produce more Gore votes when earlier standards proved not to produce enough Gore votes, but also they produced drastically different results. This means essentially that the manner in which votes were counted in Broward county was different from the standards used in Palm Beach county even though they had essentially similar machines and punch ballots. This is a CLEAR violation of the constitutional principle of equal protection. One man, one vote, counted the same way.
