I have news for you, Congress can challenge the slate unless ALL controversies concerning the certification are over today, which isn't going to happen. It only takes one Congressman and one Senator from the same state, to challenge, and I'll bet there are several.

Even if the US Supreme Court said "no recounts," that wouldn't affect the appeals from the Seminole and Martin county absentee ballot cases. The Florida Supreme Court hasn't ruled on whether it will take jurisdiction on that, even. And there is pending before the US Supreme Court a federal challenge to including the military overseas ballots that came in after November 7 (brought by individual Democrats.)

So we lose the safe harbor provision of 3 USC 5 and get into the procedure outlined in 3 USC 15, which I could explain to you but I don't think you really want me to do that. -g-

Suffice it to say that it will continue to be a mess unless Gore concedes.

Even if he lost every court case, he could still hope that some renegade Republican Electors would throw their votes his way.
