I'm not sure that I understand your post. Is it:

1. Irrelevant that Thomas has a conflict of interest in the Bush case

2. Irrelevant that such conflicts are violations of federal law

3. Irrelevant that he has not recused himself

4. Irrelevant that if he did the decision would likely be 4-4

5. Thomas is irrelavant because he is actually Scalia's puppet.
