I know, I know, but a conflict of interest is a conflict of interest and while the law states the connection between financial interest and conflict, there are just too many folks looking to call "foul"...best for him to sit this one out.

Section 455 of Title 28 of the United States Code: "Disqualification of Justices, Judges or Magistrates." This requires court officers to excuse themselves if a spouse has "an interest that could be substantially affected by the outcome of the proceeding."
