Yes, but there are two possibilities: 1) that the Supreme Court can certify the Electors to Gore, either by throwing out all the Seminole and Martin absentee ballots or if there is a remand from the Supremes to resume the manual recount; or 2) since we are outside the safe harbor, by trying get Congress to not accept the certification because the contests weren't resolved on 12/12/00 so the certification was invalid when the Electors voted. Unlikely but I don't trust the Democrats. If it's an unnecessary act, why are they screaming so loudly?
