Yes, but the constitutional conflict is that differing standards violates the equal protection promised under the U.S. Constitution. You can't get a legal recount under unconstitutional laws.

And the catch 22 is that you can't rewrite the law after 6 days prior to the election. The handcount is dead, long live the machine count.

True. They demanded a recount, they got a recount.

Then they wanted a hand count.

Problem is, there's no standard for what the recount is to look for. If you read the transcript of the Broward County hand recount, it was crystal clear that they were going out of their way to look for Gore votes. It was not a neutral, objective vote counting process. It was creating votes which the voters themselves had NOT created.
