You put it better than Scalia did right there. The issue is a constitutional one, a matter of due process, where both parties feel they've been cheated. But you can't change the process and Bush is arguing that the Florida Supreme Court did just that.

Scalia was arguing about the effects of a manual recount on BUSH and nothing was said about violating his due process.
