Not true. It was within her discretion as to whether to accept or not accept those ballots. It says she may ignore those returns. But she doesn't have to. And given she was still accepting military absentee ballots, the system was open for innocent counties to get their tallies correct, especially where a legally-sanctioned recount is in force.

I think, simply put, all the Florida court ruled is that if you're gonna give a candiate the right to a recount, you've got to provide adequate and reasonable time for that recount to take place. With the secretary of state still taking valid votes from the military absentee ballots, there was no reason to shut the counties off which were in the middle of a legally-sanctioned recount.
