The Gore campaign and Lawyers decided to protest the certification of the election in mid-November by getting the FSC to extend the protest period beyond the statutory limit. They lost that recount and it the FSC decision was vacated by the USSC on a 9-0 opinion. The Gore team ran out the clock by taking the calculated risk that they could get enough votes in the 4 counties they picked. Most legal experts on both sides said winning a contest had very long odds, that's why they took the risk. The Gore team used more of the overtime clock then the Bush team did.
