This is flawed by the fact that Judge confidence wasn't that high to begin with. Which Judges was he refering to?

Even Tribe pointed out on CNN that Justices will sometimes write a "sky is falling" decent in an attempt to swing others there way versus having as strong a belief as the opinion seems to reflect. Only time will tell, but in the meantime partisans will continue to read their own beliefs into such words.
